El mercado de agua. Variables económicas, jurídicas, medioambientales, sociales y políticas. Posibles implicaciones para las cuencas del Júcar y el Segura
Entre los diversos procedimientos que se han puesto en marcha en los últimos años para la mejora de la eficiencia económica de los diferentes mercados de bienes y servicios está el de la introducción de los mecanismos de mercado en la gestión, distribución y uso del agua. Con este artículo se quiere hacer una valoración preliminar de las implicaciones, que la reciente Ley 46/1999 de 13 de diciembre de modificación de la Ley de Aguas 29/1985 puede ejercer sobre este objetivo, así como los cambios que pueden experimentar los agentes sociales, los consumos de agua y los diferentes usos si el sistema funcionara de una forma efectiva. Por último expondremos algunas conclusiones económicas, sociales, jurídicas y políticas sobre los efectos derivados de la aplicación de la Ley. ; Among the different procedures that have been set up, during recent years in order to improve economic efficiency in the market, is the introduction of market mechanisms to manage, distribute, and control the use of water. Firstly, this study tries to evaluate the implications of the new law 46/1999 (13th December) and its effect on these new procedures. This law replaced the law 29/1985, called "Ley de Aguas". Secondly, this study analyses the changes in social agents, water consumption, and different uses of water, if this new system worked efficiently. To conclude the study will analyse the effects of this law from an economical, social, political, and legal point of view.

Economic issues in the integrated management of water resource model (IWRM) and the management unit in a territory affected by several basins: The case of the Spanish southeast
The International Water Association bets in its integrated management of water resource model (IWRM) toolbox for a management unit that covers the watershed. However, this point is debatable as there are models of IWRM implementation at the infra-basin level, or even, as in the case we present with this work, when there are several basins that interfere with a particular territory. The problems as- sociated with the confluence of two or more basins in the same territory go through the difficulties in the management of the different resources and their allocation between different uses, especially when the resources are scarce to meet the total demands of water, which occurs in the areas of South-east Spain. Here, global demands are trying to articulate within two deficit basins (the Júcar and the Segura), with external contributions from the Tajo Basin (Tajo-Segura Transfer) and with non-conventional resources from the desalination of seawater. We will try to expose the state of the art at this time, and the alternatives that arise from an economic point of view. Attempts to solve this situation come from far away, even though on many occasions, the economic aspects have not been taken into account, giving rise to investment processes in infrastructures that, due to their costs and the refusal of the users to face them, have generated unstable equilibriums that different governments are incapable to solve.

El funcionamiento económico de una institución supramunicipal clave en la gestión del agua en la Comunidad Valenciana: El Consorcio de Aguas de la Marina Baja (Alicante)

La economía es una actividad institucionalizada y de ahí la importancia de identificar y analizar las instituciones implicadas en cada fenómeno económico. En la gestión de los recursos hídricos la importancia de los aspectos institucionales ha quedado patente en la reciente historia económica española. En muchas ocasiones, el éxito o fracaso de un modelo de gestión de los recursos hídricos depende, en gran medida, de las instituciones encargadas y básicamente aquellas situadas en la escala más desagregada posible.
Con este trabajo se trata de analizar las razones del surgimiento de una institución que, en la actualidad, es clave en la gestión del suministro de agua en una zona donde la articulación de los usos agrarios, urbanos y turísticos –no olvidemos que en la misma se ubica el municipio de Benidorm–, ha permitido mejorar la eficiencia del sistema como un todo. Por otro lado, esta investigación también aporta claves sobre el funcionamiento económico de los Consorcios Administrativos, figura administrativa a la que se ha prestado poca atención desde el punto de vista económico y que con este trabajo se aportan elementos para su análisis.
El futuro de la regulación del sector del abastecimiento en España
La gestión del servicio de abastecimiento de agua es un tema de muy relevante y de plena actualidad, no solo en España sino a nivel mundial. En España, desde la forma de prestación del servicio a través de la gestión directa o la gestión indirecta, o el tipo en sí de gestión indirecta que se desarrolle –empresa privada, pública o mixta- dan como resultado prácticamente tantas situaciones como ayuntamientos existen ya que la competencia es municipal, según reconoce la Ley de Bases de Régimen Local. La heterogeneidad de circunstancias de gestión de los recursos hídricos, la fragmentación de un sector clave y la falta de indicadores comparables entre diferentes opciones para la prestación de este servicio, parece indicar la necesidad de apostar por la creación de un ente regulador independiente dada la naturaleza monopolística del sector del abastecimiento y el saneamiento, junto con el carácter esencial del bien que se gestiona. Mientras que las instituciones gubernamentales dictan las políticas generales a través de leyes y reglamentos, los operadores -públicos, privados o mixtos- son los responsables de prestar los servicios a la población, y sería el órgano regulador quien velaría por el cumplimiento de las normas. El MAGRAMA está estudiando la posibilidad de elaborar una Ley sobre el Ciclo Integral del Agua de Uso Urbano con las dificultades que esto tiene en consideración a las competencias de las Comunidades Autónomas, lo que sin duda ayudaría a homologar la gestión del agua urbana en España, regulando un monopolio natural, ahora en manos de más de 8.100 municipios y un reducido número de empresas concesionarias, auténticas detentadoras de estos servicios. En este trabajo tratamos de analizar las ventajas que supondría para España contar con una agencia de regulación similar a las existentes en numerosos países, tanto europeos como de América Latina. ; Water supply management service is a very relevant issue at present. Not only the form of the service through direct or indirect management, but also the different ways of indirect management -private, public or mixed operators- produce as a result almost as many situations as local councils exists since competence is local, as it is recognized by the Law on Local Government. The heterogeneity of circumstances for water management, the fragmentation of a key sector and the lack of comparable indicators between different options for the provision of this service, suggests the need to invest in the creation of a regulator given the monopolistic nature of the water supply and sanitation sector, together with the essential character of the good provided. All this promotes a framework for the existence of an independent regulator. While government institutions dictate the general policies through laws and regulations, operators - public, private or mixed - are responsible for providing services to the population, and is the regulator who would ensure the compliance of the rules. The MAGRAMA (Ministry for Agricultural Affairs and Environment) is studying the possibility of developing a Law on Urban Water Cycle Use, which would certainly help to standardize the urban water management in Spain, by regulating a natural monopoly, now in the hands of more than 8,100 municipalities. Water Supply Services to Cities in Spain and the Debate on Private Participation in Their Management: Which Is More Efficient?
The supply of water to towns is one of the fundamental services of any municipality in Spain, given the importance of the asset it is intended to manage, regardless of the form in which its provision is chosen. However, this is not always the case, and sometimes it is seen more as a source of extra funding for the municipality and a matter of political discussion on the convenience of one or another form of management: public or private. Currently in Spain, 45% is public management and 55% is totally or partially with private participation. In this paper we have analyzed, through their Annual Accounts (Accounts (Operating Accounts and Balance Sheet filed with the Mercantile Registry or data provided to the Ministry of Finance), the companies operating in the main Spanish cities, trying to determine the role played by private participation in the management of mixed companies to gain a better understanding of this important economic and social sector.
